These Terms of Use (“Terms”) govern your access to and use of the Knight & Co Properties website and tenant portal (the “Site”), operated by Henri Knight trading as Knight & Co Properties (“we”, “us”, “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Who we are
Knight & Co Properties is a private UK landlord portfolio site and tenant portal. It provides marketing information about our properties and, for authorised tenants and the landlord administrator, access to tenancy-related tools such as tenancy summaries, documents, support tickets, and rent guidance.
These Terms apply to the Site only. They do not replace your tenancy agreement or any other contract between you and us as landlord and tenant.
2. The Site and what it is for
The Site may include:
- Public pages — information about Knight & Co Properties and how to get in touch
- Tenant portal — for current or authorised tenants: tenancy summary, documents, tickets/support, and a rent hub with standing-order guidance
- Landlord admin — restricted tools for the portfolio administrator
The Site is provided primarily for information and operational convenience. Rent amounts, payment dates, deposit terms, and other tenancy obligations continue to be governed by your written tenancy agreement (and any formal variations), not by screenshots or summaries on the Site.
The rent hub provides guidance on paying rent by standing order. We do not take card payments or process payments through Stripe or similar payment processors on the Site. Always use the payment details and instructions given to you in writing by us or in your tenancy documentation.
3. Eligibility and accounts
3.1 Who may use the portal
Tenant portal access is limited to individuals we have authorised (typically named tenants or other persons we invite). Landlord admin access is limited to Henri Knight (or persons we expressly authorise).
3.2 Account security
If you have an account:
- Keep your login credentials confidential
- Use a strong, unique password
- Tell us promptly via the Site contact or ticket forms if you suspect unauthorised access
- Do not share your account with others unless we have agreed otherwise in writing
You are responsible for activity that occurs under your account where you have failed to take reasonable care of your credentials.
3.3 Accuracy of information
Please keep any contact details you provide accurate and up to date so we can reach you about your tenancy or account.
4. Acceptable use
You agree not to:
- Use the Site unlawfully or in a way that harms us, other users, or third parties
- Attempt to gain unauthorised access to accounts, data, systems, or areas of the Site reserved for others
- Upload or transmit malware, or interfere with the Site’s security or availability
- Scrape, harvest, or systematically extract data from the Site except as allowed by law or with our prior written consent
- Misrepresent your identity or relationship to a tenancy
- Use the Site to send spam or abusive communications through contact or ticket forms
- Reverse engineer or attempt to circumvent technical restrictions, except to the extent such restriction is prohibited by law
We may suspend or withdraw access where we reasonably believe these Terms have been breached, or where necessary to protect the Site, our data, or other users.
5. Content, documents, and tenancy information
5.1 Informational nature
Tenancy summaries, document lists, ticket histories, and rent guidance on the Site are provided to help you manage day-to-day queries. They may not always reflect the latest paper or signed records. If there is any conflict between the Site and your signed tenancy agreement (or a formal written variation), the agreement prevails.
5.2 Documents
Documents made available in the portal (for example tenancy paperwork or notices we upload) are for your legitimate tenancy-related use. Do not redistribute them publicly without our consent, except where you are permitted by law (for example sharing with an adviser).
5.3 Tickets and support
Support tickets and contact forms are for genuine tenancy and Site-related matters. We will aim to respond within a reasonable time but do not guarantee response times through the Site alone. Urgent health-and-safety or emergency issues should also be raised by the channels set out in your tenancy agreement or any emergency guidance we have given you.
6. Intellectual property
Unless otherwise stated, we own or licence the Site’s design, branding (including “Knight & Co Properties”), text, and software. You may use the Site for its intended personal or tenancy-related purposes. You may not copy, modify, or commercially exploit Site materials without our prior written permission, except for fair dealing or other uses permitted by law.
7. Third-party services
The Site is built using third-party infrastructure and services (for example hosting, database, authentication, and optional email delivery). Those providers process data as described in our Privacy Policy. We are not responsible for third-party websites linked from the Site; their terms and privacy notices apply.
8. Availability and changes to the Site
We aim to keep the Site available but do not guarantee uninterrupted or error-free access. We may update, suspend, or discontinue features (including the portal) for maintenance, security, or operational reasons. Where a change is likely to significantly affect your ability to use the portal, we will try to give reasonable notice where practicable.
9. Liability
9.1 What we do not exclude
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under English law
9.2 Site use
To the fullest extent permitted by law:
- The Site is provided on an “as is” and “as available” basis
- We are not liable for loss arising solely from your reliance on Site summaries where your tenancy agreement or formal written notices say otherwise
- We are not liable for delays or failures caused by events outside our reasonable control (including failures of internet providers, hosting platforms, or authentication services)
- We are not liable for indirect or consequential loss (such as loss of profit or opportunity) arising from Site use, except where such exclusion is not permitted for consumers
9.3 Tenants and consumers
If you are a tenant dealing as a consumer, you have statutory rights that these Terms do not affect. These Terms are intended to be fair and proportionate for a small private landlord portfolio; they do not seek to remove rights you have under housing or consumer law.
9.4 Cap on liability for Site-related claims
Subject to section 9.1, our total aggregate liability arising out of or in connection with your use of the Site (whether in contract, tort including negligence, or otherwise) is limited to £500, or such higher amount as may be required by mandatory law. This cap applies to Site-related claims only and does not limit our obligations or liability under your tenancy agreement or applicable housing legislation.
10. Privacy
How we collect and use personal data is explained in our Privacy Policy. By using the Site, you acknowledge that policy.
11. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top will change when we do. Material changes will be indicated on the Site or notified through the portal or contact details we hold, where appropriate. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms, except where acceptance is not a valid basis under applicable law — in which case we will seek consent or provide an alternative as required.
12. Governing law and disputes
These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere in the UK you may also bring proceedings in your local courts where the law allows.
13. Contact
